Home-Selling Question! Please Help!?
I'm currently selling a home via an agency, and they recently approached me with two bids. However, the agency refuses to tell me any of the information about the bidders, including their names, addresses and telephone numbers, saying that they aren't allowed to divulge that information legally.
Please note: First of all, this is a short-sale. Secondly, the agent is representing both myself and the bidders, and he asked my permission to do this. Thirdly, there are many legal questions involved in the sale in terms of furniture and other items in the home which requires me to communicate and discuss the terms of the sale in depth with the actual buyers, which is much more pragmatic than going through the agent. Lastly, if the agency is giving me a contract to sign with the name of the potential bidders, obviously there is no secrecy involved, so why shouldn't I be allowed other information like their telephone number and contact information?
I am wondering whether the agency is lying to me or not, as I'm pretty sure that there should be no reason I can't know the identity of people who want to buy my home. I'm not asking whether the agent must tell me, but whether he can tell me, as my agent insists that he is unable to do so, and not that he chooses not to.
Also, I'm wondering if the agent is allowed to make on my behalf decisions involving furniture and other items.
Thanks!
THANK YOU ALL FOR YOUR TIME AND INFORMATION
ONE FINAL QUESTION
IT IS CLEAR THAT THE AGENT DOES NOT HAVE TO CLARIFY OR GIVE OVER THE BIDDERS INFO
IT IS ALSO CLEAR THAT IT IS FORBIDDEN IF THE BUYERS REQUEST ANNONYMITY
CAN I THEN ASCERTAIN, THAT THEIR IS NO LAW FORBIDING THE AGENTS TO GIVE ME THE BUYERS INFO OF ADDRESS AND TEL NUMBER
JUST THEIR DISCRETION? CORRECT?
AS I JUST RECEIVED AN E MAIL FROM THE DOUBLE AGENT STATING THAT IT WAS FORBIDDEN WITHOUT IMPLICIT PERMISSION FROM THE BUYERS FOR HIM TO FORWARD ANY INFO OF THE POTENTIAL BIDDERS ETC
IN THAT CASE HES LYING CORRECT?
ESPECIALY, WHEN MOST OF THEIR INFO IS HAPPILY WRITTEN AND GIVEN ON THE CONTRACT SENT TO THE BANK, AND TO ME FOR MY SIGNATURE!
( SO IF THEIR WAS REQUESTED ANONYMITY, OR FORBIDDEN CLAUSES OF PRIVACY (UNLESS DIRECTLY GIVEN PERMISSION,) WHY WOULD IT BE ON THE DOCUMENT AND SENT TO ME?
UNLESS THE AGENTS LYING NOW TO PREVENT ANY SABOTAGE OF HIS COMMISSION INTERESTS
OR HE WAS JUST CARELESS IN NOT COVERING UP THE NAMES!
SORRY FOR THE SHOUTING AND CAPS, MY TYPO ERROR!
AND THANKS AGAIN FOR YOUR TIME AND INFO
IT IS MUCH APPRECIATED
I WILL NOW CHANGE MY AGENT BASED CLEARLY ON HIS MISLEADING AND DECEPTIVE SELF SERVING PRACTICES
GOD SPEED
AND THANK YOU ALL AGAIN

I have a question regarding the mortgage procedure when selling a home. I currently have a 5/1 ARM and a HELOC based on a 80/15/5. I paid the 5% of course. The 15% is the HELOC and the 80% is the ARM. Now, I've been living in my home for two years and I want to attempt to sell next year. How does this work with two mortgages?
Ok, so far not what I'm looking for. I just want to know how difficult it is to sell your home with two mortgages, particularly those two.
